Daniel Robertson - Terms and Conditions

The following terms and conditions apply to all services offered by Daniel Robertson. By accepting a quote either verbally or in writing you are agreeing to the following terms and conditions. The term "in writing" encapsulates email as well as other forms of writing.

In the following terms and conditions, "we" "us", "our" and "I" all refer to Daniel Robertson. "You", "client" and "customer" all refer to the commissioner of the project.

"Web design", "web development", "the project", etc. all encapsulate various design processes including, but not limited to, the building of personal websites of any description, the building of business websites of any description, the design of graphics of any description, the provision of search engine optimisation (SEO) for a website, or the development of a bespoke application.

Daniel Robertson aims to provide the best possible services and products for our clients and is a proponent of ethical business practices. These terms and conditions are in place for the sole purpose of protecting our business; our focus is on providing quality web design and technology solutions.

General Terms

1. All prices are inclusive of VAT.
2. Quotes are valid for 30 days.
3. It is the client's responsibility to ensure that any web site is lawful and does not infringe any copyright or any other laws. It is also the client's responsibility to carry out any market research as to the viability and profitability of any project before accepting any quote.
4. Daniel Robertson reserves the right to refuse to construct a web site that we may judge as unfit due to content or otherwise. This includes, but is not limited by, sites containing adult oriented material such as pornography, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright or are contrary to UK laws.
5. The acceptance of a quote either verbally or in writing shall be deemed as a contractual agreement between the client and Daniel Robertson.
6. At project acceptance Daniel Robertson can provide an estimated completion date; while we will endeavour to meet this date, we cannot guarantee a final completion date.
7. A deposit of 50% of the total quoted price must be provided before project commencement.
8. Once a commissioned project has commenced it will be completed using the information, data, text and images provided at project commencement or during the design process. Once the design process has been completed the project will be presented to the client, who may make any changes to design and content at this point before the final invoice is issued.
9. Once the client has approved the project a final invoice will be presented; after this invoice has been issued any further work by Daniel Robertson will be charged at appropriate rates. The client will be advised of these rates before any further work is undertaken.
10. Daniel Robertson reserves the right to alter prices at any time without prior notice. If a quote at an original price has been made it will be valid for 30 days and subsequently during the life of the current project commission, however any additional work may be charged for using the latest pricing structure.
11. A client may provide web hosting and/or domain names for use by the commissioned project. If web hosting and/or domain names are set up during the course of the project, Daniel Robertson requests that the client provide their own payment details for the purposes of web hosting and/or domain names. Daniel Robertson does not provide a web hosting service.
12. When a quote has been accepted and a developed project approved by the client, the subsequently issued invoice must be paid within 30 days.
13. Content or features listed in the original quote but not provided during the development phase by the client will be added at any time in the future, however invoices must be paid in full including sections which the client still has to provide content for.
14. All material, both text and images, supplied by the client and used in the construction of the client's web site, will remain the client's property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.
15. The copyright for all material provided by Daniel Robertson and used directly for the commissioned project, such as source code, graphics, photographs, video, animation and text, will remain the property of Daniel Robertson until such time as payment has been made in full, whereupon they will become the property of the client.
16. Daniel Robertson produce projects where every effort is made to display the pages acceptably on most popular browsers currently available, however we cannot accept responsibility for pages which don't display properly on versions of browsers released after the project is completed. Daniel Robertson is primarily concerned with, in order of consideration, compatibility with Mozilla Firefox, Google Chrome and Microsoft Internet Explorer. It is the client's responsibility to advise Daniel Robertson of specific compatibility requirements before the design process is undertaken.
17. The client is ultimately responsible for checking the correctness of the site before they give Daniel Robertson approval to make the site publicly available.
18. When a client agrees that a site can be made publicly available they are agreeing that the design and development of the site has satisfied all their requirements.

Payment and Refund Agreements

1. By agreeing to these terms and conditions your statutory rights are not affected.
2. Our payment terms are 30 days, payment must be made by cheque, cash or bank transfer. Cheques or cash can be delivered to 26 Schaw Road, Prestonpans, East Lothian, EH32 9HE unless otherwise agreed. The safe delivery of cheques or cash to this address is the responsibility of the client.
3. Daniel Robertson's preferred payment methods are as follows, in order of preference: 1. Bank transfer - this payment method should be used wherever possible, account details will be provided to the client when appropriate. 2. Cheque - where no bank transfer is possible, a cheque can be accepted at the above address (refer to Payment section 2.) 3. Cash - where bank transfer or cheque is not possible, cash can be accepted only by Mr. Daniel Robertson.
4. Any bank charges incurred by Daniel Robertson relating to payment by a client will be invoiced and will be added to the total outstanding debt owed by the client.
5. Late payments will be subject to a late payment fee of £50 plus 25% of the project's total fee for each 7 days over the 30 day payment period. Daniel Robertson reserves the right to alter these late payment fees at any time. Any clients with outstanding invoices will be advised of any changes to the late payment fees and in some circumstances the late payment fee may be waived.
6. Refunds, full or in part, will only be made where Daniel Robertson has provided a completed project or service which does not comply with the original specification. It is the client's responsibility to provide the project specification, verbally or in writing, before the provision of a quote by Daniel Robertson. Daniel Robertson strives to provide the utmost quality of service and provide clients with the products and services they desire; if we acknowledge that our service has not been up to standard a refund, total or part, will be offered. The client must prove negligence on the part of Daniel Robertson if a refund is not offered willingly.
7. If a total refund is obtained by the client, the client relinquishes all claim to the content provided by Daniel Robertson during the relevant project. Daniel Robertson may offer for the client to retain content rights in the event of a refund at our discretion.

Support and Updating Service Agreements

1. Support and updating services are available after a project's invoice has been issued to the client. These services will be charged for either according to a new quote or at an hourly rate of £10 per hour. Daniel Robertson reserves the right to alter support and updating service fees at any time, and will advise the client of these fees where appropriate.
2. Our content update service refers to any content, photographs or text which replaces any current content. It does not extend to producing new sections or pages unless otherwise noted. New sections, pages, features, etc. will be charged for according to a new quote by Daniel Robertson and treated as a separate project.
3. Daniel Robertson will normally provide a backup mechanism for complex web sites (for example, database-driven sites) and advise the client on how to administer the backups. However, Daniel Robertson accepts no responsibility for loss of data or business due to site failure. The backup mechanisms provided by Daniel Robertson are a courtesy and it is generally the responsibility of the client or the web host to take backups of any web sites. Daniel Robertson does not host or store any backups for client web sites.

Visits to Clients' Premises or other Meetings

1. Daniel Robertson can conduct the entire project over the internet, by email, video conference, telephone, etc. and reserves the right to complete projects in this manner.
2. We will visit any premises in Edinburgh or East Lothian free of charge for one initial consultation, design specification, or feedback session, if requested. Any such meeting will constitute the acceptance of a quote and the project commission, if not already accepted verbally or in writing. The client will be advised of the quote prior to the meeting.
3. Visits to premises outside of Edinburgh and East Lothian will considered where feasible. The client will be charged in terms of travel expenses plus time at £10 per hour. Daniel Robertson reserves the right to alter these charges at any time.
4. Any further visit or meeting may be charged for in terms of travel expenses plus time at £10 per hour. Any time spend on any other job, for example computer setup/repair may be charged at our hourly rate of £10 per hour. Daniel Robertson reserves the right to alter these charges at any time.

Privacy Policy

1. Daniel Robertson may collect the following information, from both individuals and organisations, for the purposes of doing business with our clients: names, addresses, contact details such as telephone numbers, email addresses and web pages, and other relevant information such as demographic and marketing segmentation.
2. Information is used for the purposes of client communications, invoicing, payment handling, and internal record keeping. Information may also be used to improve our products and services or for market research.
3. Under no circumstances will Daniel Robertson refer, sell, or otherwise forward the information you provide to any third party without your consent.
4. Daniel Robertson does not store specific client information online and does not store any payment details such as credit card details or bank account details.
5. The website www.danielrobertson.net may contain links to other websites. Daniel Robertson accepts no responsibility for the security of your information on these outside sites, for example if you sign up to another website or purchase third party products.


By agreeing to these terms and conditions your statutory rights are not affected. Daniel Robertson reserves the right to alter any of the above terms and conditions at any time. Clients will be advised of any changes where appropriate.
